1. Acceptance of Terms
By downloading, installing, accessing, or using the Arka application ("the Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Arka ("Company," "we," "us," or "our"). If you do not agree to these Terms in their entirety, you must immediately cease all use of the Service and uninstall the application from your device. Your continued use of the Service following any modifications to these Terms constitutes your acceptance of such modifications.
2. Description of Service
Arka is a personal finance tracking application designed to allow users to manually record and monitor their financial information on their personal devices. The Service is expressly NOT a bank, financial institution, payment processor, credit provider, investment platform, or financial services provider of any kind. Arka does not access, connect to, or interact with any financial institution, bank account, or payment network. All financial data entered into the Service is input manually by the user and stored exclusively on the user's device. The Company does not intentionally collect, receive, process, or store any user financial data. Please note that, like most mobile applications, Arka may rely on standard operating-system-level diagnostic services (such as Apple Crash Reporter or Google Play's crash reporting) that may transmit anonymous, non-financial diagnostic and performance data as governed by the respective platform provider's privacy policies. Such platform-level services are outside the Company's control and their data practices are governed by their respective privacy policies, not these Terms.
3. No Financial Advice
THE SERVICE DOES NOT PROVIDE FINANCIAL, INVESTMENT, TAX, ACCOUNTING, OR LEGAL ADVICE. Nothing contained in the Service shall be construed as financial guidance, a recommendation to buy or sell any financial instrument, or advice regarding any financial decision. Any figures, calculations, summaries, or information displayed within the Service are based solely on data manually entered by the user, and are provided for informational and organizational purposes only. You acknowledge and agree that you are solely responsible for all financial decisions you make, and that Arka bears no responsibility or liability whatsoever for any financial outcomes, losses, or consequences arising from your use of, or reliance upon, the Service. Arka strongly recommends that you consult with qualified financial, tax, or legal professionals before making any financial decisions.
4. Eligibility
You must be at least eighteen (18) years of age, or the age of legal majority in your jurisdiction, whichever is greater, to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the full legal capacity, right, and authority to enter into and abide by these Terms. If you are using the Service on behalf of an entity, you represent and warrant that you have the authority to bind that entity to these Terms.
5. User Responsibilities
You are solely and exclusively responsible for: (a) the accuracy, completeness, legality, and reliability of all data, information, and content that you enter into the Service; (b) maintaining the security and confidentiality of your device and any access credentials; (c) creating and maintaining independent backups of your data, as the Service operates entirely offline and the Company does not store, back up, or have the ability to recover your data under any circumstances; (d) ensuring compliance with all applicable local, state, national, and international laws and regulations in connection with your use of the Service. The Company shall not be liable for any loss, corruption, destruction, or unauthorized access to your data for any reason, including but not limited to device failure, theft, loss, software malfunction, user error, or any other cause whatsoever.
6. Pro Features and Subscriptions
Arka offers optional premium features ("Arka Pro") through one-time purchases or auto-renewing subscriptions via platform app stores. All payment processing is handled strictly by the respective platform (Apple or Google). We do not collect or store your payment information. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You can manage and cancel subscriptions through your App Store or Google Play account settings. All purchases are subject to the refund policies of the respective app stores.
7. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Arka and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service strictly for your personal, non-commercial use.
8. User Content
Since the Service operates completely offline, any data, categorizations, budget sheets, or financial information you input ("User Content") resides exclusively on your device. We do not claim any ownership over your User Content, nor do we assume any liability for its loss. You are solely responsible for exporting or backing up your User Content if you wish to preserve it.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. ARKA EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We make no warranty that the Service will meet your requirements, be uninterrupted, timely, secure, or error-free, or that any errors or defects will be corrected.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ARKA, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE.
11. Indemnification
You agree to defend, indemnify, and hold harmless Arka and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of: (a) your use and access of the Service, or (b) a breach of these Terms.
12. Modifications to the Service
We reserve the right to modify, suspend, or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that Arka will not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.
13. Governing Law and Dispute Resolution
These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which the Company is established, without regard to its conflict of law provisions. Any dispute arising from or relating to the subject matter of these Terms shall be finally settled by arbitration in that jurisdiction, using the English language. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
